NETWORK MEMBERSHIP TERMS & CONDITIONS

BestHomeSearch.com is owned by The Real Estate Savings Center, LLC,
herein referred to as the (The Company), and Managed by
Jay D. Rogers,
South Carolina Real Estate Broker: (SC License #24852).

The Company owns and manages a number of real estate related Portals and Websites including but not limited to BestHomeSearch.com. The following Terms & Conditions apply to each of the Company’s Portals and Websites.

The Company Builds, Optimizes, Markets, and Maintains Best Home Search Landing Pages throughout the United States. The Landing Pages provide Exclusive Website Marketing & Referrals for Network Members including qualified Realtors who have earned their ABR, BIC, CRS, ePRO, and/or GRI designation, as well as Mortgage Lenders, Home Inspectors, Closing Service Providers, and Homeowner Service Providers.

Mission of the Company:  The Company’s Mission is to offer Helpful Information as well as Time and Money Savings options to Real Estate Consumers by matching them to some of the most professional and cost-effective ways to locate, purchase, and/or sell residential real estate.

Goal of the Company and its Members:  The Goal of the Company and its Network Members is to become recognized as a top resource for Home Buyers, Home Sellers, and other Residential Real Estate Consumers looking for the greatest Values in Professional Real Estate Services in their hometown and/or in their destination city.

No Agency Relationship or Partnership is created or implied. Although this Network Member Agreement expects both the Company and the Members to work together for the common good of the Real Estate Consumer, it is hereby understood by the Company and all Members that each is deemed independent of the another, and that this agreement does not constitute a formal Partnership, Joint Venture, or Agency Relationship between the Company and its Network Members.

NETWORK MEMBERSHIP QUALIFICATIONS FOR REALTORS® 

If you are an Owner or Broker of an Independent residential real estate firm with a business model that offers “Negotiable Fees”, “Real Estate Rebates, “Fee for Service”, or “Full Service for Less”, you can reserve your choice of Network Membership which includes:

  • Exclusive County Website Marketing – BestHomeSearch.com builds, optimizes, markets, and maintains Exclusive County Landing Pages for only One Real Estate Broker-Affiliate in each County or County equivalent area. All Broker-Affiliate Memberships includes Exclusive City Website Marketing for the Largest City in your County area and Exclusive Countywide Referrals in the form of “Requests for Savings Offers”. Plus Broker-Affiliate Members have the Right of First Refusal to reserve additional Cities in their reserved County area.
  • Exclusive City Website Marketing Broker-Affiliate Members can earn one additional City at No Cost for each qualified Realtor and up to 12 Real Estate Service Providers they can refer who sign-up for Website Marketing on their County Landing Page. The Company accepts Realtors that have earned their ABR, CRS, ePRO, and/or GRI designation, and that have “hyperlocal” MLS search sites or web pages such as those found on AgentFire.com, AgentImage.com, and LuxuryPresence.com, etc. In lieu of referring others, Broker-Affiliates have the option to pay a website marketing fee of only $5/monthly or $42/annually for each additional City. 
  • Improved Agent Recruiting & Retention The Company’s BestHomeSearch.com system initially sets up “temporary” website links to qualified Realtors on each County Landing Page. Broker-Affiliates can use these links for Recruitment of these Agent or others. Offering Exclusive City Website Marketing to any qualified Realtors in the cities they prefer to work can be a great Agent Recruiting & Retention Tool. 
  • Exclusive County Prospect Referrals – Unlike with other Realtor Referral systems, the Company does not collect the consumer’s personal information to sell it for a big chunk of a Member’s commission. BestHomeSearch.com charges no referral fees. Plus your Countywide Landing Page has an built-in referral form that will automatically email Broker-Affiliates any “Requests for Savings Offers” from Buyers and Sellers throughout your County. In June 2024 the Company optimized and submitted BestHomeSearch.com pages for Indexing on the major search engines. The BestHomeSearch.com site now has over 1,000 Backlinks and is expecting site traffic to gradually grow through organic Search Engine Optimization.
  • Value-Added Consumer Services Because the Company’s System provides Exclusive City Website Marketing to Brokers and other Reators at little or no cost, these Members can better afford the “Increased Buyer Negotiating Power” and/or the “Shift Towards Alternative Selling Methods” associated with the New Rules for Real Estate. By adding BestHomeSearch.com to their marketing plans, Members can gain local market share by giving more Home Buyers and/or Home Sellers what they are looking for: Professional Services with Significant Savings.
  • For Realtors with the ABR, CRS, ePRO, and/or GRI designation – As a Network Member you are allowed to reserve Exclusive City Website Marketing for your Website or Web Page only if it has “hyperlocal” MLS Search functionality such as found on AgentFire.com, AgentImage.com, and LuxuryPresence.com website platforms. 

NETWORK MEMBERSHIP QUALIFICATIONS FOR REAL ESTATE SERVICE PROVIDERS 

Real Estate Service Providers with Consumer Ratings that average 4.5-Stars or more, are invited to apply for Network Membership. Each Membership includes Exclusive Countywide Website Marketing for One Service Category in at least One County or County equivalent area. At little or no cost, as outlined at the top of the website under the “For Service Providers” tab, the following Real Estate Service Categories are available on a first reserved basis:

COMPANY RESPONSIBILITIES

OFFERING GREATER VALUES FOR CONSUMERS & REAL ESTATE SERVICE PROVIDERS: the Company charges its Members little or no Marketing Fees and No Referral Fees. Because of this, Network Members can be more flexible when negotiating and/or offering Savings to Real Estate Consumers.

WITHOUT DISCRIMINATION: the Company shall have the Sole Responsibility to Review, Accept, and/or Reject Network Membership requests based on the qualifications outlined herein and on the website at BestHomeSearch.com. Such qualifications can include but are not limited to consumer reviews with at least a 4.5 Star average, Consumer Focused Time and/or Money Savings Services offered to Consumers by the Applicant for Membership, and a review of the Applicant’s Website.

CONFIRMATION: If/When Network Membership is approved, a Company Representative shall attempt to notify the Applicant by phone and/or email within One Business Day to discuss the current availability of Exclusive Website Marketing & Referral Areas.

PRIVACY POLICY: Unless otherwise instructed, the Company hereby agrees to not share Member’s personal Information other than what is available on the Member’s Website. The Company does not sell or otherwise share Member’s personal information without the Member’s permission.

WEBSITE MARKETING: The Company provides Online Marketing of Member Websites that offer Residential MLS Search for real estate consumers at a Hyperlocal Level. All Website Marketing is available on a First Reserved basis and at Little or No Cost as outlined on the “Realtor Sign-Up” and “For Service Providers” Tabs on the top of the BestHomeSearch.com website.   

PROSPECT REFERRALS: Unlike other Real Estate Referral Networks, BestHomeSearch.com does not try to capture the visitor’s personal information or other data to sell for a referral fee. By not having to pay a Referral Fee, BestHomeSearch.com Network Members can better afford to Negotiate their Fees, and/or offer Consumers better real estate Service Values.

CAN-SPAM ACT: The Company hereby agrees to follow the policies outlined in the  “A Compliance Guide for Business” by the Federal Trade Commission for the CAN-SPAM ACT.

GUARANTEES: The Company hereby guarantees that each Exclusive County or State Landing Page is built and optimized for “organic” first page placement by the Search Engines for search terms such as “Best Places to Live in (County), Best Places to Live Near (City)”, “best home search”, “(City) homes for sale) and/or other residential real estate related Search Terms. 

All BestHomeSearch.com City, County and State Landing Pages are optimized for organic first page placement on Major Search Engine, however since Search Engines use different algorithms, server farms, and data centers, the actual “organic” search term results displayed on the Search Engines often change. Therefore the Company cannot be guarantee a given placement at any given time.   

 NETWORK MEMBER AGREEMENT

REALTOR MEMBER REQUIREMENTS: Network Realtors must be an Owner, Broker, or Realtor with the ABR, BIC,CRS, ePRO, or GRI Designation.  All Realtors must be willing to Negotiate their Fees or offer Consumer Savings through a business model that provides Added-Value through Real Estate Rebates, Fee for Service, Full Service for Less, Flat Fee Listing Savings, or other significant Real Estate Savings. The REALTOR Sign-Up Tab at the top of this page provides more details including information for Agent Recruiting & Retention.

SERVICE PROVIDER REQUIREMENTS: Network Service Providers must have an Online Consumer Rating on Google or Yelp of at least 4.5 Stars and have an active website describing their professional service offerings to Home Buyers, Home Sellers, and/or Homeowners. The Company will market the Homepage or any appropriate Promotions Page selected by the Member. 

CONFIDENTIALITY: Network Members are solely responsible for providing a link to their own Privacy Policy as it applies to confidentiality of any Personal Consumer information gained through their Network Membership. Member further agrees and warrants that all confidential elements and business practices gained that are related to the Company’s Operations shall remain confidential and may not be shared outside of the Member’s firm, with the exception of a review if required by Member’s legal counsel and/or by a Court of Law.

RESPOND PROMPTLY: As a Network Member, you agree to respond as soon as possible to any Consumer Requests for specific information including but not limited information on Personal Services, Professional Credentials, Homes for Sale, and/or any “Real Estate Savings Offers” you may make as a Network Member. It is understood that a prompt response is usually the very best way to convert Prospects into satisfied Clients or Customers. Ideally, a prompt response is a personal response within 5-minutes and certainly within 30-minutes of a request during normal business hours.

ASSIGNMENTS: Qualified Realtor Members can offer Exclusive Website Marketing for Cities, Towns, or Communities they have reserved within their County, Borough, Parish, or Township area only to qualified Agents who have earned their ABR, BIC, CRS, ePRO, and/or GRI designation. Such Assignments must be presented and approved by the Company for publication.

REFERRALS FOR MEMBERSHIP: Associated Real Estate Brokers can earn Exclusive Website Marketing at No Cost in exchange for referring qualified Real Estate Service Providers for Website Marketing on their Countywide Landing Pages. Each Landing Page has a “Referrals” Link built in for this purpose. MEMBER ACCOUNTABILITY:  Member is responsible for all activities that occur under their own real estate website and their own real estate or business license. Members are independent from The Real Estate Savings Center, LLC and accountable to their Real Estate Customers and Clients. 

NETWORK MEMBERSHIP PAYMENTS:   Network Membership Subscriptions including No Cost, Monthly & Annual Marketing Fees are outlined at the top of the BestHomeSearch.com website. The Company uses the PayPal Credit and Debit Card Processing Service for Network Member Marketing Subscriptions. The Company offers a 30% discount on Annual subscription.,Any Marketing or Subscription Fees are initially set up as Recurring Payments, and Members can cancel at anytime with a notice to the Company within 3-business days of termination. Any fees paid to Realtors for Member Referrals will be paid or credited on a quarterly basis.

CANCELLATION:  The Terms & Conditions of this Agreement between the Company and the Member shall be binding as outlined herein and shall remain in effect until such a time that the Member or the Company may give notification of cancellation. The Company or the Member may terminate this agreement with or without cause at any time with written notification of termination sent by email to the other party at least 2-business days prior to the proposed termination date.

CONSIDERATION: It is hereby understood and agreed that (1). If the Company is the terminating party, the Company shall refund any Monthly Marketing Fee paid by the Member within the last 30-days. If Member has paid Annual Fee, it is understood that pro-rated refund will be made based on the months remaining on the Annual Membership Fee  (2). Should the Member cancel this Agreement, it is understood and agreed to that no further fees shall be due or payable, and any fees paid prior to the termination notification by the Member to the Company shall be non-refundable.  

INDEMNIFICATION: As a Network Member, you agree to indemnify, defend, and hold harmless the Company, its owners, officers, employees, agents, and other Network Members or Affiliates from and against any demands, claims, costs, liabilities, losses and damages of any kind including attorney fees resulting from your use or misuse of the Company’s Website Marketing & Prospect Referral Systems, or for your breach of any of the provisions of the Terms and Conditions outlined herein.

DISCLAIMER: Other than those included herein, the Company makes no representations or guarantees relating to its Exclusive Website Marketing and Prospect Referral System, its websites, web pages, Landing Pages, or other Company Services. It is also hereby understood that from time to time there may be technical or other difficulties or issues beyond the control of the Company or beyond that of the Member. Such issues may include but are not limited to the temporary loss of an Internet Connection, etc. Therefore, it is hereby agreed by all parties that such difficulties shall be remedied as soon as possible, and no such situation or similar situation that can be rectified shall be judged as a breach of these Terms and Conditions. All Systems, Programs, Portals, Websites, Web Pages, Landing Pages, or other Media created by the Company remain owned and controlled by The Real Estate Savings Center – a South Carolina Limited Liability Company. The laws of South Carolina shall govern this Disclaimer or the Terms or Conditions contained herein. Any disputes relating to this Disclaimer or the Terms and Conditions shall be settled by Arbitration Rules established by the American Arbitration Association, and any judgment for any award rendered by the Arbitrators may be entered into a court of competent jurisdiction in the State of South Carolina, City of Charleston.

THE COMPANY RETAINS THE RIGHT TO CHANGE OR UPDATE THE MEMBER TERMS & CONDITIONS AT ANY TIME: In such an event the Company shall email Members with a notification of any planned changes or updates and a 3-day grace period to respond to:
