NETWORK MEMBERSHIP TERMS & CONDITIONS

BestHomeSearch.com is owned by The Real Estate Savings Center, LLC,
herein referred to as the (The Company), and Managed by
Jay D. Rogers,
South Carolina Real Estate Broker: (SC License #24852).

The Company is an Exclusive Online Website Marketing and Prospect Referral Network for qualified Real Estate Brokers, Team Leaders, their top Realtors, and other Real Estate Service Providers, hereby referred to as (the Members). The Company provides Exclusive City Website Marketing & Referral at Little or No Cost and Does Not Charge Referral Fees.

The Company owns and manages a number of real estate related Portals and Websites including but not limited to BestHomeSearch.com,  SouthCarolinaHomesForSale.com, and CharlestonHomesForSale.com. The following Terms & Conditions apply to each of the Company’s Portals and Websites.

The Company Builds, Optimizes, Markets, and Maintains City, County, and Statewide Best Home Search Landing Pages to provide Exclusive Website Marketing & Referrals for Network Members including Brokers-in-Charge, Team Leaders, and qualified Realtors who have earned their ABR, CRS, ePRO, and/or GRI designation. The Company also Provides Countywide and Statewide Website Marketing for Real Estate Service Providers including Mortgage Lenders, Home Inspectors, Closing Service Providers, and Homeowner Service Providers.

Mission of the Company:  The Company’s Mission is to offer Helpful Information as well as Time and Money Savings options to Real Estate Consumers by matching them to some of the most professional and cost-effective ways to locate, purchase, and/or sell residential real estate.

Goal of the Company and its Members:  The Goal of the Company and its Network Members is to become recognized as a top resource for Home Buyers, Home Sellers, and other Residential Real Estate Consumers looking for the greatest Values in Professional Real Estate Services in their hometown and/or in their destination city.

No Agency Relationship or Partnership is created or implied. Although this Network Member Agreement expects both the Company and the Members to work together for the common good of the Real Estate Consumer, it is hereby understood by the Company and all Members that each is deemed independent of the another, and that this agreement does not constitute a formal Partnership, Joint Venture, or Agency Relationship between the Company and its Network Members.

NETWORK MEMBERSHIP QUALIFICATIONS 

ONLINE MARKETING for QUALIFIED REAL ESTATE BROKERS & TEAM LEADERS: If you are a Real Estate Broker or a Team Leader with a business model that offers “Real Estate Rebates, “Fee for Service”, “Flat Fee MLS”, and/or Negotiable Fees, you can reserve your choice of Network Membership which includes:

  • EXCLUSIVE CITY WEBSITE MARKETING AT NO COST– All qualified Real Estate Brokers and Team Leaders start by reserving a BRONZE Level Membership at No Cost. It includes Exclusive Website Marketing for any One Available City with a population of up to 100,000 people. There is No Cost & No Referral Fees to pay as a Bronze Network Member.
  • ADDITIONAL CITIES OF ANY SIZE AT LITTLE COST OR NO COST – Bronze Members can upgrade their Membership and reserve Additional Cities of Any Size, as outlined under “For Realtors” at the top of BestHomeSearch.com.
  • AGENT RECRUITING & RETENTION AT LITTLE OR NO COST – Only Silver, Gold, and Platinum Members can assign additional Cities of any size to qualified Realtors who have earned their ABR, CRS, ePRO, or GRI designation. Offering Exclusive Website or Webpage Marketing to Agent in the Cities they prefer to work can be a good tool for Agent Recruiting and Retention in your County area:
    • Little Cost: Exclusive City Marketing for qualified Agents is available on a first reserved basis for a Marketing Fee of $5/monthly or Save 30% at $42/annually.
    • No Cost: In lieu of paying a Marketing Fee, Brokers and Team Leaders can receive One City for each qualified Real Estate Service Provider they refer that Signs-Up for Website Marketing on their County Landing Page. Qualified Service Providers include Mortgage Lenders, Home Inspectors, Closing Services, and Homeowner Service Providers.
  • EXCLUSIVE COUNTYWIDE REFERALS AT NO COST – Only Silver, Gold, and Platinum Members are automatically emailed any “Requests for Savings Offers” received through their Best Home Search Landing Page.
  • NO REFERRAL FEES  TO PAY – Unlike other Referral Networks, the Company does not try to collect our Site Visitors personal information to sell it for Big Chunk of Network Realtor’s Commission. As a Member of the nationwide BestHomeSearch.com Network, you pay No Referral Fees. This way you can better afford to increase your local market share by Negotiating Your Fees or providing Home Buyer Rebates and/or MLS Listing Savings.

ONLINE MARKETING FOR QUALIFIED REAL ESTATE SERVICE PROVIDERS: All qualified Mortgage Lenders, Home Inspectors, and Closing Services Providers, along with Home Insurance, Home Security, and Home Improvement Companies can reserve Countywide Website Marketing on a First Reserved Basis.

  • LOW COST – Countywide Website Marketing is available for up to 4 Counties each for $5/monthly or Save 30% at $42/annually each
  • LOWER COST – Additional Counties as well as Regional, Statewide, and National Website Marketing may also be available to qualified Real Estate Service Providers.

COMPANY RESPONSIBILITIES

OFFERING GREATER VALUES FOR CONSUMERS & REAL ESTATE SERVICE PROVIDERS: the Company charges its Members little or no Marketing Fees and No Referral Fees. Because of this, Network Members can be more flexible when negotiating or offering Savings to Real Estate Consumers.

WITHOUT DISCRIMINATION: the Company shall have the Sole Responsibility to Review, Accept, and/or Reject Network Membership requests based on the qualifications outlined herein. Such qualifications can include but are not limited to consumer reviews of at least a 4.5 Star average, as well as Consumer Focused Time and/or Money Savings Services offered to Consumer by the Applicant for Membership.

CONFIRMATION: If/When Network Membership is approved, a Company Representative shall attempt to notify the Applicant by phone and/or email within One Business Day to discuss the current availability of  Exclusive Website Marketing & Referral Areas.

PRIVACY POLICY: Unless otherwise instructed, the Company hereby agrees not to share Member’s personal Information other than what is available on the Member’s Website. Other than promoting the Member’s Website, the Company does not sell or otherwise share Member’s personal information without the Member’s permission.

WEBSITE MARKETING: The Company provides Online Marketing of Member Websites at an Exclusive City Level. All Website Marketing is available on a First Reserved basis and at Little or No Cost as outlined on the “Realtor Sign-Up” and “For Service Providers” Tabs on the top of the BestHomeSearch.com website.   

PROSPECT REFERRALS: Unlike other Real Estate Referral Networks, BestHomeSearch.com does not try to capture the visitor’s personal information to sell for a referral fee. By not having to pay a Referral Fee, our Network Members can better afford to Negotiate their Fees, offer Consumer Savings including real estate rebates, or other Real Estate Promotions.

CAN-SPAM ACT: The Company hereby agrees to follow the policies outlined in the  “A Compliance Guide for Business” by the Federal Trade Commission for the CAN-SPAM ACT.

GUARANTEES: The Company hereby guarantees that each Exclusive County or State Landing Page is built and optimized for “organic” first page placement by the Search Engines for search terms such as “Best Real Estate Websites”, “Best Places to Live in the US)”, “Best Places to Live in (County), Best Places to Live Near (City)”, “best home search”, and/or other Home or Real Estate related Search Terms. 

All of our County and State Landing Pages are optimized for organic first page placement, however since Search Engine Results change and Search Engines use different algorithms, server farms, and data centers, the actual “organic” search term results displayed on the Search Engines cannot be guarantee at any given position or time.   

 NETWORK MEMBER AGREEMENT

REALTOR REQUIREMENTS: Network Realtors must be a Real Estate Broker, Team Leader, or an Agent that has earned their ABR, CRS, ePRO, and/or GRI Designation and invited by their Broker or Team Leader. As a Network Member, Brokers and Team Leaders can reserve and assign Cities to qualified Agents in their County area. All Realtors must be willing to Negotiate their Fees or offer Consumer Savings such as Real Estate Rebates, MLS Listing Savings, or other significant Real Estate Savings. The REALTOR Sign-Up Tab at the top of this page provides more details including information of Agent Recruiting & Retention.

SERVICE PROVIDER REQUIREMENTS: Network Service Providers must have an Online Consumer Rating on Google or Yelp of at least 4.5 Stars and have an active website describing the service(s) the offer to Real Estate Consumers including Buyers, Sellers, and Owners. The Company will market the Homepage or any appropriate Promotions Page selected by the Member. Website Marketing shall be on any available County Landing Page selected, reserved, and served by the Member.

CONFIDENTIALITY: Network Members are solely responsible for maintaining their own Privacy Policy as it applies to confidentiality of any Personal Consumer information gained through their Network Membership. Member further agrees and warrants that all confidential elements and business practices gained that are related to the Company’s Operations shall remain confidential and may not be shared outside of the Member’s firm with the exception of a review if required by Member’s legal counsel and/or by a Court of Law.

RESPOND PROMPTLY: As a Network Member, you agree to respond as soon as possible to any Consumer Requests for specific information including but not limited information on Homes for Sale, your Services, your Professional Credentials, or any “Real Estate Savings Offers” you may make as a Network Member. It is understood that a prompt response is usually the very best way to convert Prospects into satisfied Clients or Customers. Ideally, a prompt response is a personal response within 5-minutes and certainly within 30-minutes of a request during normal business hours.

ASSIGNMENTS: Qualified Real Estate Brokers and Team Leaders can offer Exclusive Website Marketing for Cities they have reserved within their County area to qualified Agents they are recruiting or who are already members of their Brokerage or Team.

REFERRALS FOR MEMBERSHIP: Real Estate Brokers and Team Leaders can earn Exclusive Website Marketing for additional Cities by referring qualified Real Estate Service Providers for Website Marketing on their Countywide Landing Pages. Each Landing Page has a “Referrals” Link built in for this purpose. MEMBER ACCOUNTABILITY:  Member is responsible for all activities that occur under their own real estate website and their own real estate company license or franchise rules.

NETWORK MEMBERSHIP PAYMENTS:   The Company uses the PayPal Credit and Debit Card Processing Service for Network Member Marketing Subscriptions.  No Cost, Monthly & Annual Marketing Fees, if any, are outlined under the “REALTOR Sign-Up” and the “For SERVICE PROVIDERS” Tabs at the top of the website.  Any Marketing Fees are initially set up as Recurring Payments, and Members can cancel at anytime with a notice to the Company within 2-business days of termination.

CANCELLATION:  The Terms & Conditions of this Agreement between the Company and the Member shall be binding as outlined herein and shall remain in effect until such a time that the Member or the Company may give notification of cancellation. The Company or the Member may terminate this agreement with or without cause at any time with written notification of termination sent by email to the other party at least 2-business days prior to the proposed termination date.

CONSIDERATION: It is hereby understood and agreed that (1). If the Company is the terminating party, the Company shall refund any Monthly Marketing Fee paid by the Member within the last 30-days. If Member has paid Annual Fee, it is understood that pro-rated refund will be made based on the months remaining on the Annual Membership Fee  (2). Should the Member cancel this Agreement, it is understood and agreed to that no further fees shall be due or payable, and any fees paid prior to the termination notification by the Member to the Company shall be non-refundable.  

INDEMNIFICATION: As a Network Member, you agree to indemnify, defend, and hold harmless the Company, its owners, officers, employees, agents, and other Network Members or Affiliates from and against any demands, claims, costs, liabilities, losses and damages of any kind including attorney fees resulting from your use or misuse of the Company’s Website Marketing & Prospect Referral Systems, or for your breach of any of the provisions of the Terms and Conditions outlined herein.

DISCLAIMER: Other than those included herein, the Company makes no representations or guarantees relating to its Exclusive Website Marketing and Prospect Referral System, its websites, web pages, Landing Pages, or other Company Services. It is also hereby understood that from time to time there may be technical or other difficulties or issues beyond the control of the Company or beyond that of the Member. Such issues may include but are not limited to the temporary loss of an Internet Connection, etc. Therefore, it is hereby agreed by all parties that such difficulties shall be remedied as soon as possible, and no such situation or similar situation that can be rectified shall be judged as a breach of these Terms and Conditions. All Systems, Programs, Portals, Websites, Web Pages, Landing Pages, or other Media created by the Company remain owned and controlled by The Real Estate Savings Center – a South Carolina Limited Liability Company. The laws of South Carolina shall govern this Disclaimer or the Terms or Conditions contained herein. Any disputes relating to this Disclaimer or the Terms and Conditions shall be settled by Arbitration Rules established by the American Arbitration Association, and any judgment for any award rendered by the Arbitrators may be entered into a court of competent jurisdiction in the State of South Carolina, City of Charleston.

THE COMPANY RETAINS THE RIGHT TO CHANGE OR UPDATE THE MEMBER TERMS AND CONDITIONS AT ANY TIME: In such an event the Company shall email Members with a notification of any planned changes or updates and a 3-day grace period to respond to:
