Because of changes to the MLS Cooperative Compensation Rule brought about by a class-action lawsuit against the National Association of REALTORS®, property Sellers can no longer attract a Buyer’s Broker or Buyer’s Agent by posting an offer of Compensation in the Realtors’ MLS System. Therefore, Buyers will need to negotiate and sign an Agreement that outlines the level of service they require and how their Agent will be paid. Since the Sellers will still want to attract Buyers working with Agents, it is expected most Sellers will be willing to negotiate and pay the Buyer’s Agent fee when presented as part of an offer to purchase.
